I, the signatory, a Member in the Co-created Meetups and/or The Co-created Hub Membership (hereinafter "the Membership") offered by Coaching for Transformers Ltd trading as “The Co-created Hub” (hereinafter “the Company”) understand and agree to the Terms and Conditions outlined in the Terms of Service Agreement below.
TERMS OF SERVICE AGREEMENT
Community Guidelines and Code of Member Conduct: The Co-created Hub Membership is a collaborative place guided by our core values- Connection, Collaboration and Community. It is our utmost priority to provide a safe, non-judgmental environment where other members feel heard and supported. By entering the Membership and attending the events, you agree to treat others respectfully and not transmit through the Membership any content or communication which violates the rights of others, or which is threatening, abusive, invasive of privacy or publicity rights or which encourages conduct that would constitute a criminal offence or violate any law. We reserve the right to terminate your access to the Membership should you violate our Community Guidelines and not rectify your behaviour upon receiving a written notice from the Membership moderators.
Intellectual Property: All intellectual property rights, including but not limited to patents, copyrights, trademarks, trade secrets, and any other proprietary rights, in and to any works, inventions, developments, initiatives, discoveries, designs, software, or other materials created, developed, and shared in the Membership constitute proprietary information and shall be owned solely and exclusively by the Company. You agree that the proprietary information contained in the Membership is owned by the Company and is protected by copyright, trademark and other applicable intellectual property laws. You shall not use the proprietary information in a way that constitutes an infringement of the Company’s rights or that has not been authorized by the Company. The use of proprietary information outside the Membership is strictly prohibited and infringes on the intellectual property rights of the Company and may subject you to civil and criminal penalties, including possible monetary damages, for infringement on the Company’s intellectual property rights.
Limitation of Liability: You understand and agree that the Company shall not be liable to you for any special, incidental, exemplary, consequential or indirect damages, including, without limitation, loss of use, loss of profit, loss of business opportunity, loss of data or any other damage incurred directly or indirectly from your participation in the Membership, the Membership events, Kristina's Circle or/and your engagement in services, products or collaborations with other members and/or third parties endorsed by the Company such as founding partners, business partners and speakers, even if you have been advised of the possibility of such damages. You understand that the content shared inside the Membership is for informational purposes only and is not a substitute for counselling, mental health care or therapy and does not prevent, cure or treat any mental disorder or medical disease.
Membership Content: You understand that the content and events provided in the Membership are subject to change. The Company makes no warranty that the information provided, regardless of its source, is accurate, complete, reliable, current or error-free. The company disclaims all liability for any inaccuracy, error or incompleteness in the content shared at the events, in the Resources section of the Membership or any provided materials.
Member Support: Member support is available between 10:00 and 17:00 GMT at [email protected].
Refund Policy: Refunds will only be provided within up to 3 working days of the expiry of the free trial period and are subject to the Member failing to cancel their free trial subscription prior to its expiry. The PayPal refund processing fees will be deducted from the overall refund amount. Following the 3-day timeframe, no refund will be provided.
Dispute Resolution and Recovery of Litigation Fees: In the event of any dispute or claim arising out of or relating to this agreement, including any questions regarding its existence, validity, or termination, the Company and the Member shall first attempt to resolve the dispute through good-faith negotiations. If the parties are unable to reach a resolution within 30 days of written notice of the dispute, either party may initiate mediation by providing written notice to the other party. The mediation shall be conducted by a mutually agreed-upon mediator.
If any legal action, arbitration, or other proceeding is brought for the enforcement of this agreement, or because of an alleged dispute (mishandled through good-faith negotiations), breach, default, or misrepresentation related or arising from this agreement, the prevailing party or parties shall be entitled to recover reasonable solicitor fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.
Governing Law: This agreement shall be governed by and construed in accordance with the laws of England & Wales. Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of England & Wales.
