By entering the Co-created Hub Network (hereinafter "the Hub") and signing this agreement offered by The Co-created Hub Limited, a company registered in the United Kingdom with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ (hereinafter “the Company”), you understand and consent to the Terms and Conditions outlined below.
TERMS OF USE OF THE CO-CREATED NETWORK
1. Community Guidelines and Code of Conduct
The Co-created Hub Network is a collaborative place guided by our core values- Connection, Collaboration and Holistic Growth. It is our utmost priority to provide a safe and non-judgmental environment where other partners and members of the Hub feel supported. By entering the Network and attending events, you agree to treat others respectfully and not transmit through our platform any content or communication which violates the rights of others, or which is threatening, abusive, invasive of privacy or publicity rights or which encourages conduct that would constitute a criminal offence or violate any law. We reserve the right to terminate your access to the Hub should you violate our Community Guidelines and not rectify your behaviour upon receiving a written notice from the Network moderators.
2. Intellectual Property
All intellectual property rights, including but not limited to patents, copyrights, trademarks, trade secrets, and any other proprietary rights, in and to any works, inventions, developments, initiatives, discoveries, designs, software, or other content and materials created, developed, and shared in the Hub membership and platform constitute proprietary information and shall be owned solely and exclusively by the Company. You agree that the proprietary information contained in the Hub is owned by the Company and is protected by copyright, trademark and other applicable intellectual property laws. You shall not use the proprietary information in a way that constitutes an infringement of the Company’s rights or that has not been authorized by the Company. The use of proprietary information outside the Hub is strictly prohibited and infringes on the intellectual property rights of the Company and may subject you to civil and criminal penalties, including possible monetary damages, for infringement on the Company’s intellectual property rights.
3. Limitation of Liability
You understand and agree that the Company shall not be liable to you for any special, incidental, exemplary, consequential or indirect damages, including, without limitation, loss of use, loss of profit, loss of business opportunity, loss of data or any other damage incurred directly or indirectly from your participation in the Hub, the Network events, Kristina's Circle or/and your engagement in services, products or collaborations with other members, subscribers and/or third parties endorsed by the Company such as founding partners, service partners and affiliate partners, even if you have been advised of the possibility of such damages. You understand that the content shared inside the Hub and on the Co-created Hub website is for informational purposes only and is not a substitute for counselling, professional mental health care or therapy and does not prevent, cure or treat any mental disorder or medical disease.
4. Hub Content
You understand that the content and events provided in the Hub are subject to change. The Company makes no warranty that the information provided, regardless of its source, is accurate, complete, and error-free. The company disclaims all liability for any inaccuracy, error or incompleteness in the content shared during the Hub events; on the Co-created Hub website; inside the Co-created Network membership or in any other materials provided by the Company.
5. Dispute Resolution and Recovery of Litigation Fees
In the event of any dispute or claim arising out of or relating to this agreement, including any questions regarding its existence, validity, or termination, the Company and the Partner shall first attempt to resolve the dispute through good-faith negotiations. If the parties are unable to reach a resolution within 30 days of written notice of the dispute, either party may initiate mediation by providing written notice to the other party. The mediation shall be conducted by a mutually agreed-upon mediator.
If any legal action, arbitration, or other proceeding is brought for the enforcement of this agreement, or because of an alleged dispute (mishandled through good-faith negotiations), breach, default, or misrepresentation related or arising from this agreement, the prevailing party or parties shall be entitled to recover reasonable solicitor fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.
6. Governing Law
This agreement shall be governed by and construed in accordance with the laws of England & Wales. Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of England & Wales.
